These terms and conditions of sale (terms of sale) apply to the purchase & shipping of goods in the United Kingdom through this website. Please read these terms of sale carefully before placing your order. By completing the order process you confirm your unconditional acceptance of these terms of sale. We will make responsible efforts to ensure that the information about the goods available through this website is accurate and up to date. However, we do not warrant or guarantee that there will be no errors in the description and/or pricing of the goods or those goods will always be available if you wish to place an order to purchase them.
None of the material contained in this website is to be relied upon as a statement of representation in relation to goods sold therein. All images, illustrations and descriptions of goods are for information only and you are invited to contact us if you need any further information about goods. All capacities and dimensions stated are approximate and may be subject to change without notice.
We reserve the right at any time and without notice to modify the information about goods displayed on this website, including without limitation information on prices, description and availability of goods. Please note that in the event of an incorrect price or product specification being published on this website, we are not obliged to fulfil any orders placed at the incorrect price or supply products to fulfil an incorrect product specification. Product Warranty/Manufacturer's Guarantee
All goods detailed on this website are supplied with the relevant manufacturer's standard guarantee only. If you have need to claim against manufacturer's guarantee you must contact us through the 'Contact Us' page and your details will be forwarded to the relevant manufacturer. Please note that many of the products displayed will only be covered by the manufacturer's guarantee when they have been installed to the manufacturer's guidelines. Warm and Toastie do not offer any product warranty or guarantee on any product detailed on this website.
Placing Your Order
To place an order you must be 18 years of age or over. To place an order you will have to select the goods on this website, select your preferred shipping method, at your discretion other optional services and click on the 'PLACE ORDER' button. Before completing the checkout procedure you will be requested either to register for or log-in to your personal account. We cannot accept orders placed in any way other than as detailed.
If you have any problems during the placement of your order or if you are not sure whether or not your order made through this website has been finalised, contact us using the 'Contact Us' page.
When you place an order you make an offer to us to purchase the goods you have selected. Orders are subject to availability and acceptance by us and we may, at any time and at our sole discretion, refuse to accept your order, including, but not limited, to the cases where:
- You provide us with incorrect information, including without limitation, insufficient or incorrect payment details, incorrect billing information, insufficient or incorrect shipping address or fraudulent information
- There is an error on our website relating to the goods that you have ordered, for example, an error relating to the price or description of the goods are displayed on our website
- The goods that you have ordered are no longer available through our website.
- We believe that you are under the age of 18
We will not be liable to you or any third party for withdrawing any goods from this website, removing or editing any materials or content on this website, refusing to process an order or suspending any transaction after we started to process it. If we cannot accept or process you order we will contact you by email as soon as possible, but in any case no later than 30 (thirty) days from the date of your order. If we cannot accept or process your order because the goods are no longer available, or because of an error in the price and/or other information about the goods for which you have placed an order, we will contact you and suggest alternative products where possible. If you do not wish to accept our suggestions then we will cancel your order in relation to those goods we cannot supply and refund you any money that you have paid to us in respect of those goods.
If you have placed the order through this website you will receive an automated email confirming receipt of your order, this email contains the relevant details of your order such as quantities, price, shipping terms. Please note that this email does not constitute an acceptance of your order. Unless you cancel your order, your order will be accepted and the contract between us and you will be concluded only when we dispatch the goods. At such time you will receive an order shipment confirmation email informing you that we have dispatched all, or a part, of the goods covered by your order.
Cancelling Your Order
Order can be cancelled at any time before being processed by us. If you wish to modify or cancel your order, please contact us via our 'Contact Us' page. We will not accept order cancellations made in any way other than listed above. Once your order has been processed you may only exercise your right of withdrawal according to this procedure.
Returning Goods
You must obtain a returns note number before sending anything back to us, otherwise we may not be able to process your return. Failure to contact us in advance of any returns eliminate us from any responsibility of the item. We cannot be held responsible for items returned without authorisation.
If you believe that products you have purchased from Warm & Toastie are defective or damaged upon delivery report this immediately to the delivery driver and detail the defect or damage on the driver's copy of the delivery note. You must contact Warm & Toastie immediately to report the defect or damage. All repairs or replacements of goods are at the manufacturer's discretion and consistent with the terms and conditions specified by their guarantee. Where it is necessary to inspect the goods on site and no responsibility can be laid with the manufacturer or Warm & Toastie, an inspection charge will apply, to be paid by you, the customer. Warm & Toastie will not take responsibility for any consequential damage or loss as a result of product defect(s).
Unwanted goods returned to us must be in an unused, re-saleable condition and will be subject to a 50% restocking charge. Goods which are 'special order' are not eligible for restocking.
Privacy Policy
We do not disclose buyers' information to any third parties other than when order details are required as part of the checkout procedure. In this case, the third party have their own privacy policy, details of which can be provided upon request.
Statutory Rights
These terms and conditions do not affect your statutory rights. There are governed by the law of England/United Kingdom.
Circumstances Beyond Our Control
We will make every effort to perform our obligations under these Terms of Sale. However, we cannot be held responsible for delays or failure to perform if such delay or failure is caused by any circumstances beyond our reasonable control, including, without limitation, an act of God, explosion, flood, fire or accident, war or civil disturbance, strike, industrial action or stoppages of work, any form of government intervention, a third party act or omission, failure of our supplier(s), failure by you to give us a correct delivery address or notify us of any change of address, or a failure by you to affect payment.
We will inform you of any such unforeseen circumstances as soon as possible and will fulfil our obligations as soon as reasonably possible. Should this interruption continue beyond a 30 (thirty) day period, you will be entitled to cancel the order and given a full refund where applicable.
Intellectual Property Rights
Warm & Toastie logo/trademark as well as all trademarks, images, illustrations and logos displayed within this website whether registered or not, may not be reproduced or used without prior written authorisation. Failure to comply with these terms may result in prosecution.
